Terms of service
Terms of Service
These Terms of Service apply to your use of the Cane Hamilton website and purchases made through our online store.
In these terms, “Cane Hamilton”, “we”, “us” and “our” refer to the seller operating this store. “You” and “your” refer to the customer or website visitor.
Please read these terms before placing an order. You may save or print a copy for future reference.
For enquiries about these terms or an order, contact canehamiltonsupport@gmail.com.
1. About our store
Cane Hamilton sells clothing and accessories online. Our store is hosted on Shopify, which provides the e-commerce platform used to display products and process orders.
Your purchase contract is with the seller operating Cane Hamilton, not with Shopify.
These terms apply to consumer purchases. Nothing in them excludes or limits your statutory rights.
2. Using our website
You must provide accurate information when placing an order and have authority to use the payment method you select.
You must not use our website for fraud, unlawful activity, distributing malicious software or attempting to gain unauthorised access to our systems or another person’s information.
If you create an account, keep your login details confidential and contact us if you suspect unauthorised use.
3. Product information
We aim to provide accurate product descriptions, photographs, prices and availability information.
Please review the product description, size guide, materials and care instructions before ordering. Photographs are illustrative, and screen settings may cause minor differences in how colours appear. This does not affect your right to receive goods that match their description.
Where measurements are approximate, this will be indicated. Any stated tolerances do not remove our responsibility to supply goods as described.
If you have questions about a product, contact us before purchasing.
4. Placing an order
To place an order, select your products and available options, add them to your basket and complete checkout.
You will have an opportunity to review your order and correct errors before submitting it. Please check your items, sizes, quantities, delivery address and contact details carefully.
Submitting an order creates an obligation to pay if we accept it.
Our checkout and order communications are provided in English.
5. Order acceptance
After you place an order, we will send an acknowledgement confirming that we have received it.
Unless we expressly confirm acceptance earlier, your order is accepted and a purchase contract is formed when we send your dispatch confirmation.
Before acceptance, we may be unable to fulfil an order for a valid reason, such as unavailable stock, an unsuccessful payment, a material listing error or reasonable evidence of fraud. If this happens, we will notify you promptly and refund any payment collected for the unfulfilled items.
After acceptance, we will not change the agreed price or substitute a materially different product without your agreement. Your legal rights remain available if we cannot fulfil the contract.
6. Prices and payment
The currency and total amount payable are shown at checkout. Applicable taxes and delivery charges will be displayed before you submit your order.
Available payment methods are shown at checkout. Payment is taken through the payment provider selected during checkout and may be subject to authorisation and security checks.
We will not charge you for optional extras without your express consent.
Prices may change for future purchases. Changes do not affect orders we have already accepted.
If we identify a material pricing error before accepting your order, we will contact you with the correct information and give you the choice of proceeding at the corrected price or cancelling for a full refund. We will not charge an increased amount without your agreement.
7. Promotions and discounts
Any conditions applying to a promotion, discount code or bundle offer will be disclosed before purchase.
Discounts apply only where the stated eligibility conditions are met. Codes cannot be combined unless the relevant offer expressly allows this.
For partial returns of discounted orders, refunds will reflect the amount actually paid for the returned items. Any conditions affecting a bundle or promotional refund must have been clearly disclosed before purchase and must comply with consumer law.
Promotional conditions do not remove statutory cancellation or faulty-goods rights.
8. Delivery
Delivery destinations, charges and estimated times are provided in our Shipping Policy and during checkout.
We will deliver within the agreed delivery period. If no delivery period has been agreed, we will deliver without undue delay and no later than 30 days after the contract is formed.
If delivery is delayed, contact us. Where required by law, you may set an appropriate additional delivery period and cancel if we fail to deliver within it.
You may be entitled to cancel immediately where we refuse delivery, an agreed delivery date was essential in the circumstances, or you told us before ordering that delivery by that date was essential.
If you validly cancel because of non-delivery, we will refund the payments due without undue delay.
We remain responsible for goods until they come into your physical possession, or the possession of a person you nominate to receive them, other than the carrier. If you independently arrange a carrier that we did not offer, different statutory risk rules may apply.
A tracking update alone does not remove your rights if an order has not been delivered. Contact us if your parcel is missing or arrives damaged.
9. Cancellations, returns and refunds
Our Returns & Refunds Policy explains how to cancel a purchase, return goods and request a refund.
For most online purchases, you may cancel without giving a reason until 14 days after the day you receive the goods. You then have a further 14 days after notifying us to send them back.
For change-of-mind returns, you are responsible for the direct return postage costs, as explained in that policy. We cover reasonable and necessary return costs for faulty, incorrect or misdescribed goods.
Statutory exceptions may apply to genuinely personalised goods and certain sealed hygiene-sensitive products where the legal conditions are met.
You may inspect clothing and try it on as you would in a shop. Any lawful deduction for handling beyond what is necessary must reflect an actual reduction in value.
Please refer to our Returns & Refunds Policy for the full process, applicable refund deadlines and optional cancellation form.
10. Faulty or misdescribed goods
Goods must be of satisfactory quality, fit for purpose and as described, in accordance with the Consumer Rights Act 2015.
If your goods do not meet these requirements, you may be entitled to a refund, repair, replacement or price reduction, depending on the circumstances.
These rights are separate from change-of-mind returns and may continue after the cancellation period has ended.
Contact canehamiltonsupport@gmail.com if there is a problem with your purchase.
11. Our responsibility to you
If we breach these terms or fail to use reasonable care and skill, we are responsible for loss or damage that is a foreseeable result.
Loss or damage is foreseeable if it is an obvious consequence of our breach or was contemplated by you and us when the contract was formed.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.
We do not exclude your rights relating to faulty goods, misdescribed goods, delivery or refunds. Using suppliers, carriers, Shopify or payment providers does not remove our legal responsibilities to you.
Products are sold for domestic and private use. We do not agree to supply them for business or resale purposes under these consumer terms.
12. Events outside our reasonable control
If an event outside our reasonable control affects fulfilment, we will contact you as soon as reasonably possible and take reasonable steps to minimise the effect.
Such an event does not automatically remove our obligations or your rights. If the resulting delay gives you a legal right to cancel, you may cancel and receive the refund required by law.
13. Intellectual property
Website content owned by or licensed to Cane Hamilton, including original text, photographs, graphics and branding, is protected by applicable intellectual property laws.
You may view, save and print content for personal, non-commercial use, including retaining copies of your purchase documents.
You must not reproduce or commercially exploit protected content without permission from the relevant rights holder, except where permitted by law.
References to third-party names or trademarks do not, by themselves, imply affiliation or endorsement.
14. Reviews and customer content
If you submit a review or other content for publication, it must reflect your genuine experience and must not be unlawful, misleading or infringe another person’s rights.
You retain ownership of your content. By submitting it for publication, you allow us to display it and make reasonable formatting changes needed to publish it, without changing its meaning.
We may moderate content for legitimate reasons, such as spam, unlawful material or personal information. We will not remove a review solely because it expresses a negative opinion.
15. Privacy
Our Privacy Policy explains how personal information is collected, used and shared when you visit our website, contact us or place an order.
Where consent is legally required for marketing or non-essential cookies, it will be requested separately. Making a purchase does not automatically constitute consent to marketing.
16. Complaints
If you have a complaint, email canehamiltonsupport@gmail.com with your order details and a description of the issue.
We will investigate and seek to resolve the complaint fairly and without unnecessary delay. Supporting information may help us assess the matter, but requesting it does not remove your statutory rights.
You do not have to complete our complaints process before exercising any legal right or remedy available to you.
17. Changes to these terms
We may update these terms for future website use and purchases.
The version in effect when your order is placed will apply to that order, unless a change is required by law or expressly agreed with you.
We will not retrospectively change an existing purchase contract to your disadvantage without a lawful basis.
18. Applicable law and disputes
Nothing in these terms deprives you of mandatory consumer protections or access to courts available under applicable law.
If you live in England or Wales, Scotland or Northern Ireland, you may bring proceedings in the courts available to you under the applicable jurisdiction rules, including the courts of your home jurisdiction where the law permits.
These terms do not require compulsory arbitration or prevent you from using statutory remedies.
